Former Intelligence Chief Gen. David Tinyefuza aka Sejusa has been sent back Luzira Prison up to 23rd February when the court martial will make a decision on his bail application.

In a court session to hear the bail application today at General Court Martial in Makindye a Kampala suburb, the prosecution team submitted that granting Gen. Sejusa bail will jeopardise on-going investigations “since he is a high ranking officer.”

Prosecution further submitted that sureties presented by Gen. Sejusa don’t qualify since they are not serving military officers.

The sureties presented included embattled Lord Mayor Erias Lukwago and Dr. Kizito Deo, a surgeon at Case Hospital.

Sejusa had applied for bail pending determination of the criminal cases against him.

The court martial led Maj. Gen. Levi Karuhanga also ruled that it has jurisdiction to try Gen. David Sejusa despite High Court case.

Sejusa’s lawyers had petitioned the High Court to block his trial in the General Court Martial arguing that “denying him a salary and other benefits, withdrawal of his army uniforms, guns, refusal to deploy him, failure to provide him any means of transport, meals and housing amounts to constructive dismissal from the Uganda People’s Defence Forces.”

The court said Sejusa is still a serving army officer.

Commenting on the court decision to send Sejusa back to Luzira, Mike Mabikke, one of his lawyers said the defence team is going to appeal.

“We have already given notice. We are going to appeal.”
